Terms of Service

1. General

These terms of service apply to the use of the website and services of Toegankelijk360 B.V. (“Toegankelijk360 AI”, “we” or “us”), registered in the Netherlands. By using our services, you agree to these terms.

2. Services

Toegankelijk360 AI provides the following services:

• Automated WCAG accessibility scans using AI technology
• Manual accessibility audits by certified specialists
• Accessible web development and technical consulting
• WCAG repair & recovery services
• Reports and accessibility statements

3. Licence

We grant you a limited, non-exclusive, non-transferable licence to use our services for your own business or personal purposes. You may not resell our services or use them to build competing products without our written consent.

4. Acceptable use

You agree not to use our services for:

• Scanning websites you do not have permission to test
• Illegal activities or violation of third-party rights
• Excessive use that burdens the infrastructure (unauthorised automation)

5. Accuracy of results

Our automated scans provide coverage of 60–70% of WCAG criteria. We do not, however, guarantee full WCAG conformity based on an automated scan alone. A legally valid conformity statement requires an additional manual audit.

6. Liability

Toegankelijk360 AI is not liable for indirect damage, consequential damage or loss of profits arising from the use or non-use of our services. Our liability is at all times limited to the amount you have paid for the relevant service in the past 12 months.

7. Intellectual property

All intellectual property rights in the software, reports and content of Toegankelijk360 AI vest in Toegankelijk360 B.V. Scan results of your own website are your property.

8. Governing law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands.
